Sakazuki killed a full ship of innocent people for justice. CD murder, imprisone and enslave people for fun while the admirals protect them. Marines killed a full village of pregnant womena and unborn children just to try and catch Ace like it was a game. Who r the bad guys again? Luffy stole food? They might have more honour, and are less likely to harm indiscriminately, but even Luffy commits crimes all the time, he stole food in Alabasta, he stole treassure in Skypeia (the Skypeian's were willing to give it to him but he didn't know that as he was running away as fast as he could with the stolen treassure), and he even has a known cat-burglar on his team (who stole the wallets of all the actual innocent people in her village). So they might be "good" pirates, but they definitely still commit crimes, so Smoker is not wrong when he says that. Smoker might be commiting a violation entering Punk Hazard, but you could say he's in "hot pursuit" of a criminal, which would likely have different legal implications in his situation depending on how the law works in one piece.
