While I cannot explain the game side of the ordeal, movies often get away with it because the music they use is often the same music from labels that movie distributors own (i.e. NBCUniversal owning the Universal Music Group, which owns Virgin Music Group, Def Jam Recordings, Bravado, Capitol Music Group, EMI, and more). So, the music you hear in movies from Universal, Paramount, etc. is most likely from a subsidiary or sister company. That said, why buy the cow when you can get the milk for free?
