This Fan Content Policy is meant to help answer some common questions about using IO Publishing’s intellectual property (IP) in fan content (“Fan Content”). We at Io Publishing are truly inspired and honored by the content our fans create and the engagement of our community. We hope you understand that these guidelines are meant to protect our properties so we can keep making wild and wonderful things for you all to enjoy.
If you would like to use our IP, we ask that you follow these guidelines and rules:
- We ask that you make any Fan content that you share with our community free.
- “Free” means you don’t sell your Fan Content or otherwise condition access it on consideration of any kind including payment, subscriptions, newsletter signups, surveys, memberships, registrations, or anything similar. It also means you can’t use Fan Content in connection with, or in order to promote paid services, websites, or the like;
- “Free” also means that others, including Io Publishing, may freely access, view, share and use your Fan Content without any strings attached (like approvals, licenses, credit, payment, etc.)
- Do not create NFTs (non-fungible tokens) or cryptocurrencies using our IP or related to our IP in any way.
- You may use Fan Content in connection with a Twitch, YouTube, or other account that is monetized with sponsorships and advertisements so long as such sponsorships or advertisements do not promote anything that is considered competitive or harmful to Io Publishing.
- We ask that you clearly identify your Fan Content as unofficial by including this note: “This work is unofficial Fan Content created under permission from the Io Publishing Fan Content Policy. It includes materials which are the property of Io Publishing, and it is neither approved nor endorsed by Io Publishing.”
- Also, don’t state, suggest, imply, or do that could mislead people to think, that your Fan Content is official, endorsed, sponsored, or approved by Io Publishing or any of our affiliates.
- We ask that you don’t use our IP in any way that is harmful to us. For example:
- Do not modify or remove our legal notices or policies from our IP;
- Do not use any of our trademarks or logos in a way that could be confused as indicating your work is official;
- Do not use our music without obtaining express written permission from us first. We develop wonderful music with trusted partners that have certain rights and a stake in the music that they help us produce.
- Do not create Fan Content that defames, disparages, or depicts any of Io Publishing, or any of its affiliates, managers, members, officers, employees, contractors or agents, in a negative way.
- We ask that you don’t create Fan Content that is or could be harmful to others.
- Do not use Io Publishing IP in a way that is offensive, racist, sexist, homophobic, transphobic, pornographic, obscene, ableist, ageist, grotesque, damaging, disparaging, or defamatory.
- Do not use Io Publishing IP in a way that violates any third-party right, including any privacy, publicity, intellectual property or proprietary right.
- Do not create Fan Content that promotes drug or alcohol use or any illegal activity.
- Do not create Fan Content that is harmful to minors in any way.
- It should go without saying, but you are solely responsible for following any local, state, regional, or national laws as they pertain to your Fan Content. Io Publishing will not be held liable for any violations or legal fees. We will also not act as legal counsel on your behalf. If you have any questions about your local laws, please seek counsel.
- We have the right to stop or restrict your use of Io Publishing IP at any time, for any reason or no reason.
If you follow the above, you should be okay! Please keep in mind, these guidelines do not, in any way, constitute grant of any proprietary rights or licenses to Io Publishing IP. We reserve the right to stop or restrict the use of our IP at any time – even if it follows the above guidelines – for any or no reason. We also reserve the right to update this policy and FAQ at any time and for any reason.
