You’re reading it as “Kira only kills murderers who intentionally kill.” He’s specifically referring to people who kill other people and saying “the old Kira wouldn’t punish a man who accidentally killed someone else or killed someone in self-defense.” He should be aware of some of the deaths even without his memory. He definitely knows about Lind L. Taylor and the FBI agents. He probably knows about the first guy taking hostages in the first episode. So he knows for a fact Kira doesn’t only kill murderers.
