About the eight vs. six survivors...At the trial, Jack said, "Only eight of us survived the crash...She took care of us...She tried to save the other two, but they didn't..." and then Kate interrupts and tells him to stop.

He was trying to REMEMBER, and he only got two out of three correct. And Charlotte said it was "progress". So, it appears that Daniel is having issues with his memory.
