AGREEMENT OF USE OF THE STL FILES AND 3D MODELS

1. TERMS OF USE

By purchasing STL files from LAST SWORD MINIATURES OTRAS ENT SIN PJ (LAST SWORD MINIATURES from now on), you agree to the full terms of this agreement.

If you do not agree with any of the terms of this agreement, please do not purchase, or use our STL files in any way.

LAST SWORD MINIATURES grants you a non-transferable, non-exclusive license to 3D print the STL files for your personal use, according to the following terms of use:

1.1) You can create as many 3D prints of the 3D models contained in the STL files as you wish for your personal, non-commercial use.

1.2) You may not license, sell, rent, or commercially exploit in any way the STL files, or 3D prints of 3D models contained in the STL files.

1.3) You may not manufacture, by any method, reproductions of the 3D prints of the 3D models contained in the STL files.

1.4) You may modify the scaling to print at a different size than provided, duplicate or create derivative works from the 3D models contained in the STL files, provided that such modifications and the use of the modified one is strictly personal and for non-commercial purposes.

1.5) You may not distribute, copy, reproduce, republish, post or transmit in any form or by any means the STL files or 3D prints of the 3D models contained in the STL files. They may only be printed for personal, non-commercial use.

2. RESPONSIBILITY

2.1) LAST SWORD MINIATURES has no responsibility for any damage that may occur to the devices and 3D printers used for the use of these STL files.

2.2) LAST SWORD MINIATURES is not responsible for providing technical support for the use of STL files.

2.3) Although all supported files have been tested on our printers, LAST SWORD MINIATURES is not responsible for providing technical support for the use of STL files. is not responsible for their correct operation on other printers due to the large number of variables (different printer models, resins and settings used)

JURISDICTION

With respect to any dispute or disagreement that may arise between the parties regarding the interpretation of this AGREEMENT or its performance, the parties, expressly waiving any other jurisdiction that may correspond to them, submit to the jurisdiction and competence of the Courts and Tribunals of Móstoles (Spain).

ACUERDO DE USO DE LOS ARCHIVOS STL Y MODELOS 3D CONTENIDOS EN LOS ARCHIVOS STL DE LAST SWORD MINIATURES.

1. Al comprar archivos STL de LAST SWORD MINIATURES, acepta los términos completos de este acuerdo.

Si no está de acuerdo con alguno de los términos de este acuerdo, por favor no compre, o use nuestros archivos STL de ninguna manera.

LAST SWORD MINIATURES le otorga una licencia no transferible y no exclusiva para imprimir en 3D los archivos STL para su uso personal, de acuerdo con los siguientes términos de uso:

1.1) Podrá crear tantas impresiones 3D de los modelos 3D contenidos en los archivos STL como desee para su uso personal y no comercial.

1.2) No podrá licenciar, vender, alquilar, ni explotar comercialmente de ninguna forma los archivos STL, o las impresiones 3D de los modelos 3D contenidos en los archivos STL.

1.3) No podrá manufacturar, mediante ningún método, reproducciones de las impresiones 3D de los modelos 3D contenidos en los archivos STL.

1.4) Podrá modificar el escalado para imprimir a distinto tamaño del proporcionado, duplicar o crear obras derivadas de los modelos 3D contenidos en los archivos STL, siempre que tales modificaciones y el uso del modificado sea estrictamente personal y no tenga fines comerciales.

1.5) No podrá distribuir, copiar, reproducir, republicar, descargar, publicar o transmitir en cualquier forma o por cualquier medio los archivos STL o las impresiones 3D de los modelos 3D contenidos en los archivos STL. Solo podrán ser impresos para uso personal y no comercial.

2. RESPONSABILIDAD

2.1 LAST SWORD MINIATURES no tiene ninguna responsabilidad en el daño que pueda producirse a los dispositivos e impresoras 3D usados para el uso de estos archivos STL.

2.2 LAST SWORD MINIATURES no tiene la responsabilidad de ofrecer asistencia técnica para el uso de los archivos STL.

JURISDICCIÓN

Respecto a cualquier disputa o desacuerdo que pueda surgir entre las partes sobre la interpretación del presente ACUERDO o sobre su cumplimiento, las partes, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, se someten a la jurisdicción y competencia de los Juzgados y Tribunales de Móstoles (España).

Hola, ante todo muchas gracias por vuestro trabajo, es magnífico. Me gustaría saber si estaría permitido el uso de los modelos 3d (modificados para bajarle el número de polígonos) y texturizados en un videojuego (no comercial y siempre dando el suficiente crédito a los dueños y artistas de los modelos, osea vosotros). No me queda claro si en caso de publicar el videojuego de forma online se incumple la cláusula 1.5. En el caso de un videojuego me parece casi imposible acceder a los modelos 3d (que estarían simplificados y por tanto no aptos para impresión). La idea sería hacer un videojuego de Estrategia por turnos (tactics) similar a un tabletop. Sería un proyecto de hobby sin ánimo de lucro e, insisto, siempre dando crédito y publicidad a vosotros. Espero vuestra respuesta, un saludo!

the use of the word *purchasing* might not be the correct wording you are going for with a document such as this. Purchasing means I am buying these files from you which I am technically not buying them. I, as a patron am giving you money to allow you as an artist or an art group to continue producing art. As an artist you are making the product of your art available to your patrons. This is not a purchasing transaction(which could be subject to taxes and the like). You could most likely just switch the word purchase to download and that would work fine. This would also cover you from IP conflicts if a company feels like they have a solid case that you are infringing on their IP by "selling" products that are too similar to their own such as Aztech themed lizard men. But if you are "freely" giving your art to your patrons that would not be something they could contest(I am not a lawyer but it makes sense)

Just a thought about 1.4 - perhaps instead of making it its own separate rule, which sounds like you are forbidding people from digital "kit bashing/modification" of the files for personal use. Instead you could add to each of the other 1 rules a clause that includes "modified or derived works". Eg 1.2 becomes something like: 1.2) You may not license, sell, rent, or commercially exploit in any way the original STL files or derivatives/modifications there of; nor prints from the STL files or derivatives/modifications there of. Of course seek proper legal counsil for proper working, this is just an example that might communicate clearler to patreon backers what the TC are.

We cannot be responsible for something that has so many variables and in which the file is the least important of all. It is more likely that any damage has to do with a mechanical failure, or poor maintenance of the fed and the tank than any other cause. And that's without going into variables like resin, which is a world in itself. Or the wear of the screen and the light, which sooner or later happens to all printers. In fact it was decided last month, that since some of you use programs that we cannot test, the supports will only be included in chitubox. And we have chosen Chitubox because it works very well and it is free in all its functions. If you run the file in programs like mexmisher, or open them in other printing programs, it usually works fine. But you can alter the geometry and strange things can happen to the file. And we can't test them in all of them. As we can't control what you do, we can only recommend you to use chituitubox, and in case you have problems we will try to help you to find them. All those who have asked us so far can be summarized in two general cases. Lack of fed or screen cleaning and lack of exposure. We have been there for almost a year now. We know that the files we supply to you work as they are. We test them on average 4 or 5 times before we give them to you. And we can test them because they are the ones we will offer for sale in Print on Demand. It's in our workflow. We have also gone to the trouble of having elegoo, anycubic and soon creality printers, when it would be easier for us to use the same on the farm. I don't think anyone else is going to that kind of trouble regardless of size. And of course all the patreons that have the conditions drafted are similar to these. Actually the only reason why it has been included is because of a recommendation from our account manager in order to protect the intellectual property in the future. It is nothing that with normal use will affect any of you.

So according to what was writen, you take no responsibility for anything like at all? I put salamanders into lychee slicer and it say the models were not manifold. And the print did failed. Disapointing. Guess they are not your problem now.

For personal use we will never get into what you do, if you convert or not. These are guidelines to protect the ip and not to make derivatives of the product for commercial purposes. Whatever you do for you, for our part will always be well done.
