Terms of Service (For doodle request & commissions)

Please read the Terms of Service carefully, by commissioning me, you are agreeing to the terms outlined below:

I. General Disclaimers

• I reserve the right to decline a request/commission for any reason at anytime; this includes if I am not comfortable with the request.

• I have the right to terminate/cancel the request/commission due to disrespectful behaviour, poor or ineffective communication, a breach of the Terms of Service.

• Terms outlined here may vary slightly depending on the commission type.

II. Payment & Fees

• All prices are in AUD.

• Payment is due in full upfront, unless otherwise specified by me in the commission outlines.

• All payments made are non-refundable, please read all information carefully before making payment.

• Payment accepted only via BuyMeACoffee.

• I do not accept payment in the form of exposure, trades etc.

III. Process & Delivery

"Doodle"

• Delivery time approximately 1 - 2 weeks from the time I notify you of start. Depending on schedules and other factors. No rush request accepted.
  

• No discussion or revision, please ensure the submitted request contains all details.
  - If the request falls into something I am unable/uncomforable with doing, I will discuss with you to work it out.
  - Mal-intent requests are non-refundable.
  

• Finished work will be delivered in digital form via my social media platforms.
  

"Commission"

• Delivery time of 2 weeks - 1 month from the time I notify you when I have started on your commission.
  
  - A rush fee will be charged for tight deadlines, this must be discussed and agreed upon prior to start of commission.
  
  - I will always complete your commission with a balance of time and quality to ensure the best. But there may be times of delay due to other circumstances. I will inform you ASAP and keep you updated.

• The delivery process is in 3 main stages, it may vary slightly depending on the commission type and complexity:
  
  1. Concept
  - Very rough doodle/sketch outline and discussions of your vision.
  
  2. Sketch
  (50% of full commission fee paid upfront prior to commencement)
  - Detailed sketch will be sent for approval
  - One major revision and multiple minor revisions (covered by default)
  
  3. Shading/Coloring/Painting
  (Remaining of the full commission fee paid upfront prior to commencement)
  - Shading or Coloring rough layout will be sent for approval
  - One major revision and multiple minor revisions allowed during rough layout (covered by default).
  Once approved, no further revisions will be allowed.

• WIPs will be sent during the commission process. They will be low-res and watermarked.

IV. Revisions

• Revisions due to my own negligence are free.

• Excessive minor revisions will incur additional fees.

• Each additional major revision will incur an additional fee of 40% of the full commission fee.

• It is at my discretion as to what constitutes minor and major revisions.

V. Client Obligations

• Please write your request clearly and concisely.

• For "doodle", ensure your request does not fall into item description of things that can't be done. Please check the do's and don'ts , if there are questions feel free to message me.

• For "commission", provide detailed and precise descriptions, clear reference images, mood boards etc. The better you show me these, the closer we will reach your vision!

• Please respond in a timely fashion to prevent delays.

• You are responsible for the legality, eligibility and use of your commission request, references provided etc. I am not responsible to perform any preliminary checks, provide resolutions or refund should any complications occur.

• Please read through the ToS and commission information with care.

VI. Copyright & Usage Policy

• I, the artist, retain the rights over any commissioned works.

• I reserve the right to use/post the commissioned work, including the process on my social media or portfolio for showcase purpose.
  - For "Commission", watermark will be layerd over, also posted at lower resolution for social media platforms.

• For "Commission", if you don't want it to be used for showcase purpose, there will be a 10% additional fee of the original price.

• Copyright of characters portrayed in the work belongs to their rightful owner.

• The final product is strictly for your personal use only, unless you purchase commercial rights.

• You don't need to credit me when sharing or using the commissioned work. I appreciate very much when you do.

• For commercial use, you must purchase the rights from me. The price will be negotiated. Credit is required when using the work in any form commercially.

You may use or edit the commissioned work in the following ways:

• Print the work for personal use (maximum 20 prints)

• Crop/resize the image to use as avatar, header, in video etc.

• Use the work as reference for personal use.

• Post the work on social media.

You may not use or edit the commissioned work in the following ways:

• Claim the authorship as yours.

• Remove my watermark/signature.

• Color in the work's sketch or lineart, paint over or make alterations to the final work in ways not covered under what's allowed above.

• Use the work and any of its progress piece in any technology related to NFTs, Cryptocurrency or AI.

• Reproduce the work commercially without purchasing the rights from me.

VII. Cancellation and Refunds

• A refund is not permitted when the stage paid for is complete.

• You may cancel the commission at anytime, after which I will issue a refund equivalent to the amount of work not done. However, any platform transactional/processing fee incurred will not be covered. (For "commissions" only)

• I reserve the right to cancel and refund the money for your commission at any time.

• You may not file a chargeback against me when the stage paid for is complete.

• For "doodle' If the request breeches the " Do's & Don'ts " or is of mal-intent, and upon discussion for changes, a reasonable request cannot be reached, refund will not be permitted.

VIII. What You Receive (For "Commission")

• Sketch stage workpiece at 300 DPI at request.

• Final artwork at 300 DPI in JPG/TIFF/PNG/GIF depending on commission type and needs.

• You can request me to provide you with versions of work for social media upload.
