What Should We Cover on RRF?

Help us narrow down what things we need to be covering this week for you all! Chime in below with what legal news has been on your mind that could use some good OA analysis. Don't forget to heart any other ideas in the thread that you want covered!

This feels like they’re teeing up a challenge to NYT vs Sullivan https://bonnercountydailybee.com/news/2025/feb/23/new-idaho-bill-would-cost-you-100k-5-years-in-jail/

Archer

To further the above, what is it *supposed* to look like. In the Old Times, if the government didn't comply with an injunction or other court order, whose job was it to make it happen? Has it just been Norms™ this whole time?

Make Orwell Fiction Again

Another too late comment but wondering if there is a way to force a flat tax and to tax churches. Solves the budget bs and everyone hates him already so…

Jensie Jaye Hudson

OK i know this is probably too late, and this is probably Gavel Gavel content, and maybe will be better to wait til the judge makes his ruling, but I don't think anyone has mentioned the hearing with Judge Ho and Bove about Eric Adams!

All-inclusive Gender Resort

Who enforces court orders when the law enforcement is all under the executive branch. What does a contempt-of-court timeline look like?

Julie W

"Only the president and AG can interpret laws for executive branch" seems like an onion worth peeling.

Dan in Massachusetts

How on earth does the Trump administration have any legal authority to end New York City's congestion charging system?

Liam Child

Seconded from the US. God that whole situation is shameful. We will never live this down. This is a genocide (https://www.genocidewatch.com/_files/ugd/b3be20_f94d49b6bf324793b8a63d4d67bdfb78.pdf) and we are talking about putting boots on the ground to encourage it.

Jenessa Lynn

SAVE Act could use a “call your reps b/c this sucks” shout out. Absolute nightmare scenario for voter suppression. Voter ID on steroids. Plus gives ICE access to the voter reg database. 5 dems in the house voted yes last session! The margin in the house is so tight. This bill can be stopped!

Jenessa Lynn

Obviously this is bad, but exactly how bad? https://www.texasobserver.org/ice-prosecutor-dallas-white-supremacist-x-account/

Archer

What does it really mean when someone (not #PINO) is held in contempt by a judge?

James Ito

I assume Matt is already on top of the firing of 20 immigration judges; just noting that I'd love to hear what Matt is experiencing. https://www.wgbh.org/news/local/2025-02-19/fired-massachusetts-immigration-judge-worries-about-long-term-impact-of-lost-staff

All-inclusive Gender Resort

Someone suggested to change your status on your tax withholding forms to "exempt". What are the legal ramifications of doing that?

Unnamed Muppet

States Attorney's General suits regarding withholding all federal funds to providers of transgender care of minors.

FRED R GROOTHUIS

Thank you

Ryan

Europe here, freaking out about Ukraine. Maybe a tiny bit on how fucked up it is that they look set to carve up a country

oh good what luck

We have a great interview on this coming soon!

Matt Cameron

Air crashes ?

Gmork

related - maybe the sierra club/greenpeace suits, too?

citationy stuff

can you also cover what the hell the army corps of engineers does and how it fits in with the new fossil fuel rollbacks/overriding of NEPA?

citationy stuff

I think it’s less “traveling” and more “fleeing” that I had in mind

Celeste de la Cabra

Can you touch on the post office? I don't think enough people understand what's at stake.

Aminah

IANAL but you should be you. If you want to travel overseas in the next 4 years, /when/ you want to travel, then you can start putting thoughts towards the potential outcomes of losing the coin flip & it's a MAGA clown at the gates. But for now, imo don't waste the mental energy/stress on worrying about it.

I am a philosophical hole

Is it at all possible that even though this seems pretty terrible, that it might have been the only way to a better political path? Like maybe this will actually get bad enough that a critical mass of people will remember it foreever and become permanent liberals?

Garry Myers

I live in California and all of my reps are Democrats. When I call my reps, what concrete actions can I ask them to perform to fight this? (For both state and national representatives)

Devon Hollowood

There was a law passed making it illegal to vote to not assist in enforcing priorties of the administration. Basically making it illegal to vote for anything that would equate to "sanctuary cities" was the intent. The effect is that it does make it illegal to even vote for anything that is contrary to the administration. First I have heard of badges and I am a Tennesseean.

Michael Blank

Well, Mississippi democrats are firing back against the republicans with https://www.nbcnews.com/politics/politics-news/mississippi-lawmaker-introduces-contraception-begins-erection-act-rcna188938 Then there's the SAVE act, which while not currently in front of the house is still lurking in the wings https://www.congress.gov/bill/118th-congress/house-bill/8281 And, of course, the tomfuckery of republicans trying to cut back on SNAP and Medicaid to pay for Cheeto Mussolini's tax cuts

Gamers4DorknessFallsIsFilmingSoonHYPE

What about helping us file bar complaints against these criminal lawyers? We need to stop letting the lawyers off the hook. They need to face disbarment, prosecution, and lengthy imprisonment.

Ryan

Maybe not for RRF but a Wednesday episode when Trump replaces the out going Postmaster General (DeJoy)

Sent from Disneyland

Seconding Bunnywithaswitchblade. How concerned do we need to be about this executive order that dropped yesterday? https://www.whitehouse.gov/presidential-actions/2025/02/ensuring-accountability-for-all-agencies/

GavinNewsomMetalBonesTruth

The government has said under oath that Musk is not they head of DOGE and has no authority. If they can trace actions back to Musk on paper, does that open the door to STATE criminal charges for identity theft, privacy violations, etc.?

Christopher Bosch

Ok, here's one for ya. What are Matt's thoughts on (A) filing bar complaints, and (B) whether it'd be reasonable to file for Rule 11 sanctions in various cases where the DOJ is advancing Trump's bullshit claims? While some cases might have colorable claims, the birthright citizenship case seems ripe for moving for Rule 11 sanctions merely for attempting to defend it. By the same token, such efforts seem like they'd be violations of the DC Rules of Professional Conduct (e.g. Rule 3.1), so a bar complaint would be appropriate. This is Sidney Powell/Rudy Giulianni levels of crap arguments, and I think we should make any lawyer who defense it as miserable as possible.

Philly Basement Bar is back open, and isn't taking this shit lying down.

Strategies for work-a-day activism to oust musk from all things government.

Oso Hermoso

Did Tennessee really pass a law making it illegal to vote in favor of pro-immigrant policies? And requiring immigrants to wear badges indicating their nationality?

Warren McDonald

Did I make a mistake changing my gender marker on my passport to X? I did it right after the election and got it in like a month before the changes removing that option. I did it specifically because I correctly assumed it would be my last chance to do it for a while. Now people are saying that this could mark you for easier prosecution or prevent you from leaving the country and I’m freaking out a little bit. I have a contingency plan to leave the country if I have to (I’m half Costa Rican and a dual citizen) but I worry I accidentally kneecapped it. Is this just baseless fearmongering coming from well meaning folks?

Celeste de la Cabra

Trump's latest EO that says the president and the AG are the only ones who get to interpret the law

Bunnywithaswitchblade

The people the U.S. has deported to Panama, instead of their country of origin or where they have citizenship, are now apparently being held in a jungle detention camp. (See NYT article below) I was under the impression that we couldn't send a noncitizen to a country where they would be detained or harmed? 8 U.S.C. § 1231(b)(3) Also, when they remove a noncitizen to a third-party country, does the government have to show why it's "impractical, inadvisable, or impossible" to send them to their country of origin? Importantly, who can challenge these violations and is it only on appeal to the Board of Immigration Appeals or are these justiciable in Federal court? https://www.nytimes.com/2025/02/19/world/americas/us-migrants-panama-jungle-camp.html
