We begin with a quick review of some of the stranger legal issues raised in this week’s Presidential debate, including such mysteries as whether it is legal to murder babies upon delivery and the factual guilt of the Central Park Five 22 years after they were exonerated by DNA evidence and a third-party confession. In our main story, we review the chaos that the Supreme Court’s legalization of Presidential crime is already causing in Donald Trump’s hush-money case and discuss the relative merits of pushing his sentencing back until after the November election. Finally, Matt drops a footnote to explain an overlooked legal story in this week’s news involving a remarkably rare grant of a common defense motion.
Re: the change of venue, does a small town ever campaign to get their venue back? Like on the basis of their 1st amendment (or whichever one it is) rights to be jurors or something?
In voire dire, if jurors are asked e.g. if they think priests are all pedos and someone says Yes the judge can ask them if they can be objective anyway.
Why don't these small towns get the chance to say whether they can give someone a fair trial? I don't necessarily think they can, but I can imagine if someone did something terrible where I live, I might feel like I want the chance to do jury duty

I’m a lawyer in a European country, and I’ve been surprised how there are so many post-conviction briefs AND that there can be a change of venue post-conviction. Also, in our system the sentence is given at the same time as the guilty verdict, so this kind of delay would not happen. So fascinating to see the differences!

If SCOTUS were to overturn Trump's conviction based on their immunity ruling, does that guarantee the case is dropped? Being post-verdict, is there any way to re-try the case?

Timothy McVeigh too--no doubt there are a few more I am not thinking of, but those are the only two I can think of offhand. It really just never happens. (I meant to mention in this episode that even the Boston marathon bomber was denied a COV, which is kind of astonishing considering what an important day/event the marathon is for all of us here and much it really hit everyone.)

IANAL but the Prosecuting Donald Trump podcast suggested the sentencing delay is a good thing because if he was sentenced prior to the election he'd emergency appeal to SCOTUS and who knows what they'd do to give him a big court win right before Election Day.
