Privyet, fellow citizens! We begin with a quick look at recent events following  Jack Smith’s new superseding indictment in Trump’s January 6th case in DC. Why are Trump’s lawyers saying that Clarence Thomas “directed” them to file a motion to dismiss? And does DC federal judge Tanya Chutkan even care that this defendant who happens to be charged with four counts of trying to overturn an election is running for President at all

Then in our main story: In an indictment filed this week, the Department of Justice has charged two Russian state media operatives with funding an officially unnamed production company which is allegedly (but also definitely) Tenet Media, the home of mediocre anti-woke crusaders like Dave Rubin, Tim Pool, and Lauren Southern (among others). Thomas takes us through some of the most entertaining facts alleged in the indictment, including an extremely real investor who is definitely in Paris and not Moscow, the Tucker Carlson Russian propaganda video which was a little too much even for Tenet’s producers, and why anyone (including Tim Pool) could have ever believed that Tim Pool could have possibly been worth $100,000 an episode. Matt then breaks down some of the history of the Foreign Agents Registration Act and how this indictment sets a new standard for its enforcement in the 21st century--and what (and who) might be next.

The Kraken Lawyers are other examples, right? Surely judges would have to agree that law school is kind of a "you must be this smart to ride" filter. I get all that I think. What you said makes sense generally and the T3BE question about the kid who runs off with a 6 pack of beers after leaving cash on the counter is a good example/counterexample of those points. If the cashier had made the sale, even if he didn't intend to sell to a minor, he would be guilty because that crime has no intent component; however in the scenario presented, there was no act & no transaction/sale took place so he didn't do it. I guess my point is the law seems to be unable to infer basic human cognition and competence from someone's other publicly known actions and statements. You can't accidentally make propaganda videos for a foreign nation or unintentionally summon a rabid mob to murder the vice president. Why can't the prosecution be like "Your Honor, given the defendant can run a YouTube channel/be the literal fucking president/file taxes/ brush his own teeth/walk & breathe at the same time, I humbly submit that we all know his hurr durr routine is a crock of shit"

Generally, to be culpable, you have to intentionally perform "a specific act" that is illegal (unless the statute says something like "malicious", "willfill", "negligent", etc.). That doesn't mean you have to know that the act is illegal, and your belief that it is legal (called "mistake of law") is not a defense. A "mistake of fact" can be a defense, though... it's not bigamy if you thought the divorce was final when you got remarried, even if it technically wasn't yet. So, yeah, the defense is essentially "I'm a useful idiot."

I don't get how "I'm too dumb to prosecute the intent component of this law" keeps working for these assholes. Like why there isn't some requirement to self-educate sufficiently to not be a total fucking idiot? "But I'm too dumb" doesn't work for other intent-based stuff, does it? "Your honour, my client could not possibly have intended for his neighbor to die because he does not know what a bullet is, let alone how a firearm functions". Cool story, but he did intend to point the weapon at the victim and pull the trigger, right? Pim Tool, Rubin, et. al. absolutely did intend to take money from some random Russian guys in exchange for undermining the US government, right? I just don't think "la la la I can't hear him going 'Privyet?? Something something nyet something video. Great episode! For a few years I ran the (mildly successful) Tim Pool Clips twitter account (still do but not as active now) so this news was incredibly funny and vindicating. Tim Pool can claim to be an ignorant victim all he wants and perhaps legally he is but he’s been in this industry long enough that he should know this stuff was dodgy as hell. He may not have known whose useful idiot he was but he must have known he was someone’s idiot. Tim Pool’s connections and finances are far more questionable than you’d ever guess. What I’m eagerly waiting for is whether some of Tim’s other connections get exposed. I’ve never mentioned this publicly because there’s still more reporting work that needs to be done on it (so see this as a world exclusive for fellow OA patrons) but as recently as 2 years ago Tim was secretly working with companies connected to Sean Hannity without ever mentioning it. He also had weird connections to Cambridge Analytica including having lived with one of the people connected to it. This Hannity connected company is also involved in running the websites for at least half a dozen other right wing grifters. No one has broken this story but the evidence is out there and at one point I was working with the SPLC on it but unfortunately we lost contact. For anyone who doesn’t know who Tim Pool is I’d honestly recommend keeping it that way
