Preparing to Rapidly Respond on #RapidResponseFriday

Folks, we have some ideas lined up for this week but still want to know we're covering what you all are looking for on #RRF. What do you want to hear OA cover this week?

Please let us know below! And also, please use that heart button on comments to give us an indication of numbers, so we can gauge interest!

And, if you have specific legal questions on a given topic, feel free to comment with them!

In case anyone wants to read it, CAS released their decision and… boy does it somehow only get worse the more we learn about this… https://www.tas-cas.org/fileadmin/user_upload/CAS_Award_OG_15-16__for_publication_.pdf

This verge article has links to the various filings. https://www.theverge.com/2024/8/14/24220228/disney-wrongful-death-lawsuit-subscription-terms

Disney is apparently trying to use a mandatory mediation clause in a Disney+ Eula to force a wrongful death claim due to allergic reaction into mediation

To me, it's obvious that there is racism at work here. Maybe I'm just too American, but it seems very odd that right after the first all-black podium at the Olympics they try to take the Bronze back. It's truly an odd situation.

I really want to know the state of the Olympic agency, the IBA (international boxing association (seemingly corrupt Russian back org) and Imane Khelif Kind of an intersection between WTW and OA. Seems like there is ALOT of libel misinformation and deformation.

Can states really refuse to certify the election is we win and can trump subsequently be named the winner? It seems the way the electoral college is set, that the electors dont actually have to select the winner of that state, that its at their discretion?? Thom Hartman calls it the 'Silent Coup'

Plus, you dont see a medal stripped from an athlete unless they were caught cheating or something. Normally, the IOC had no problems issuing a second medal. So stripping Jordan of her bronze is HIGHLY irregular. Im not sure how often a refusal to re-investigate is, but the reasons for their removal has been proven to be false. It seems there is zero legal recourse

I know, I know. The world is ending

My F1 thingy! The DOJ is officially looking liberty for anti-trust violations (over the rejection of the Andretti bid) Is there any chance??

This is actually just a follow up on a recent T3BE. If the guy with the *amazing* World Cup tickets had called 911 to go to the house, and then carried on his way to the game, would that have met the legal duty of care (if not the moral obligation)?

Never in my life did I think my love of gymnastics Code of Points minutiae, knowledge of 90’s rap stars, and international law credits would somehow intersect, but here we are lol

This is based off my previous request: Can you explain the legality of this recent trend of anti class action lawsuit waivers many companies are now incorporating? Printer driver update example: https://photos.app.goo.gl/tGE2H5yHsyHKDyCQ6 Website example: https://www.mcdonalds.com/us/en-us.html

I've been wanting to hear analysis on Scofield v. Guillard (related to Idaho student murders). The interesting pivot of this case is a pro se defendent who claims her psychic abilities are being disctriminated against -- but also the amount of leeway that the Judge has been providing her at the expense of the plaintiff continuing to be defamed in filings.

Tim H

The prosecutor in Arizona who misapplied DOJ policy in the fake electors case.

Another comment on the Disney lawsuit, just wanted to add that it would be nice to get a deeper dive into what exactly arbitration is, how it works and why companies like it so much.

Brendan O'Brien

What are the chances that the former guy gets one of his bails revoked for saying he's going to flee the country?

Tara Churchill

This topic could even be bigger than a rapid response if you like. A state constitutional amendment proposed on a primary ballot (thinking that more conservatives would vote) and worded in a way to intentionally confuse voters. Could be interesting to hear about plain language requirements that some states have

This one is 100% on Patreon - there's no need for it to be an app in the first place! If they weren't chasing engagement or whatever other harebrained MBA metrics trying to be a social media bullshit, they'd be much better at what their customers actually want: facilitating payments to content creators.

Came here to ask this very question: https://imgur.com/gallery/6lQP3eV

Judge Merchan shot Trump down again (I should maybe work on my wording). I assume Trump's legal team will continue to delay by any means possible, but... What means have they left? Wasn't this something like the third time he shut this argument down? And isn't he complaining in this particular ruling about the arguments not changing? Can he hold these lawyers in contempt yet?

Unlikable Internet Goblin

The defeat of the two amendments in Wisconsin's election yesterday - if passed, they would have removed the governor's ability to spend federal money without the legislature's approval.

Andrea Singletary

I second the Imane Khelif lawsuit, and also the Jordan Chiles desaster. What even is the Court for Arbitration in Sport? How weird are all the procedural issues? It seems like there was a big no-no with the judge guy representing Romania in other cases. It feels like this was a predetermined outcome from CAS and the IOC, but was it?

Think Kamala will actually be declared the winner if she wins the most swing states? I’m increasingly worried about pro trump election officials trying to steal it?

Hey, Elon and the rest of the delusional people who thought that a woman who punches good was a secret man are being sued by her. How doss that work? Does it even have a chance of success or consequences?

No name

You probably have better ideas, but I thought of OA when I read about some Vegas hotels searching rooms during the DEFCON hacker conference to look for "hacking tools" (🙄 https://www.404media.co/here-are-the-hacker-tools-a-def-con-hotel-is-hunting-for/ ). Apparently room searches have been normal in Vegas since the 2017 shooting, but I seem to remember a T3BE question about an expectation of privacy in a hotel room? I'm too lazy to go look up the details, I'm guessing the difference is you can expect privacy from the state but not from the corporation, but I thought the OA tie-in was interesting.

Can you do a surface level coverage of how Disney is trying to dismiss a wrongful death lawsuit because the person agreed to arbitration when they signed up for Disney+. There isn't too much to report but it would be nice to acknowledge it since it is all over social media.

YakkoWarner

https://www.bbc.com/news/articles/c8jl0ekjr0go The Disney Allergy Lawsuit The Disney+ terms of service can prevent you from suing the parks?

The App Store requiring changes to the Patreon model seems the obvious suggestion.
