SEC v. Jarkesy 1) Did the court overrule Atlas Roofing? 2) What is a public right and what is a private right? 3) With this new precedent, can other agencies (not the SEC) still adjudicate civil cases using administrative law judges?

2024-06-27 03:13:44 +0000 UTCPlease specifically address Snyder v US published on 6/26. It looks like the right wing just literally legalized bribery as long as you’re smart enough to actually pay it after the government official performs in the manner requested. They do this by calling it a gratuity instead of a bribe. Am I reading this wrong??

2024-06-27 00:21:38 +0000 UTCSome roundups on recent Supreme Court decisions would be nice (still hoping to get some insight on what Matt thinks about Jackson's thoughts RE: the majority opinion on the Starbucks NLRB case) but I am hoping we get some analysis of the alleged spread of privileged communication in the Cop City RICO case some time in the future. Obviously it seems like it's an ongoing situation, but having privileged communications be spread to basically every party in a RICO case is... not a great look for the DA's office.

2024-06-26 23:52:28 +0000 UTCSecond this, and would love if the Assange plea deal coverage also touched on what happened with the sexual assault allegations against him, just to get a fuller picture. (Between that and recent efforts to rehabilitate serial abuser Jacob Appelbaum, it seems again like privacy rights bros are too happy to throw women under the bus if it means they get one over the state.)

2024-06-26 22:45:26 +0000 UTCGoogle tells me a few migrants have begun a class action purporting fraud by DeSantis. Claims about what they were promised, what they were told to convince them to board the flight, paid bounties to recruit others to join, and what was promised upon arrival. It's insane to me that the 24 hour news cycle has left this in the dust. These people call themselves "Christians" and then do this.

2024-06-26 19:17:17 +0000 UTCMaybe too much for rapid response but this is interesting https://x.com/DougtheLawyer/status/1805712920292245629 If I've got this right, there's a court appointed appeals lawyer in Texas who apparently just phones-in the same 2 appeals (that have been denied like 75 times). So not only do they lose on appeal, but they then can't go back and make legitimate appeals that should have been raised the first time around.

2024-06-26 18:34:17 +0000 UTCI've heard a couple of legal/political analysts note that SCOTUS decided the mifepristone case based on standing rather than on the merits. They seemed to dislike this and viewed it as kicking the can down the road since it doesn't shut the door on challenges against mifepristone. Isn't SCOTUS correct in rejecting the case on standing, though? It seems like the correct thing procedurally, and the anti-choicers will have to do the work of finding someone who actually has standing and bringing the suit from scratch. Whatever the individual motivations each justice had, the decision itself is fully a Good Thing, right?
Help, I'm trapped in a podcast factory!

2024-06-26 18:28:55 +0000 UTCI would love a brief history of some other cases the DOJ settled using the same "by information" mechanism as the Assange case and/or other cases were the DOJ convicted someone without taking physical custody of the defendant. If Casey is available I'd love to get a prosecution POV on this ending. My outsider impression from the news coverage is that the DOJ opted for the "declare victory and get out" path but maybe there's details that point to a more nuanced explanation for how/why they resolved it this way.

2024-06-26 18:12:05 +0000 UTCHave we done a roundup of the insane caseload at the Supreme Court? What’s to come still and how the pile got so big?
