The transcript trial coverage stuff is valuable enough, fun enough, and in demand enough that I 100% want to do it. However, it's going to either have to be the only thing we do for OA for the foreseeable future, or else we somehow need to do that massively labor intensive thing PLUS keep up old OA. I have a solution and I'm very excited about it. Hopefully I can tell you soon. But in addition to figuring that out and re-configuring some scheduling because of that, I also have had to do a number of things to finalize the whole "no more that fucking guy." It's been very nice, let me tell you but also time consuming. And then, wouldn't you know it, I'm sick as well. Let's just say IT'S BEEN A WEEK. So that's what's going on with me. But I will have an OA episode out tonight, for sure.
Now, to explain the title of this post. I've been torn, since the settlement, between the desire to want to speak right away and the fact that I really could write an entire fucking book on this experience, and want to. Add in there the need to fundraise paying off the legal debt, and also the fact that I will never have free time in my life, and it's a lot of competing plans and motivations. But I thought of something I might want to do to accomplish some of what I want to.
I'm posting this as a QnA thread for... the entire shit. The whole shit thing. Smith v Torrez. And the same principles apply: ask anything you want to know, and also please vote by hearting the questions you want to hear. This will tell me what people most need/want to know so I can prioritize it. The main story of what happened may really need to be told in longer form, and so if the questions are such that it just feels like I'll need to wait until I can do that, then I may have to defer until then. But, it may also be a bunch of stuff, especially around the legal fight, that I can answer pretty easily. And I've noticed that Patreon added the ability to add stuff for one-time purchase. So, I might use that to make this some sort of fundraiser for legal debt.
And so, ask away. The only thing I'd say is - please be respectful, and do not dox anyone who hasn't released their name publicly. There is no harm in asking what you want to know, but I also offer zero guarantee that I will answer every single question. However, I sacrificed a LOT in order to be able to speak freely, so... you can bet I want to do so.

Thomas was very responsive and kind. Months earlier I had shared/recorded a very personal story for a future OA ep about an abortion I had at 16 following a sexual assault, my awful experience at a pregnancy crisis center I accidentally stumbled into, and my need to get a judicial bypass and stand up for myself in court to obtain an abortion without parental consent. At the time: I felt completely comfortable/good about getting my story out there post-Dobbs. When Andrew took over the finances, I panicked a bit about the audio. I kept picturing Andrew listening to it, or putting it up as part of a compilation for like a Patreon bonus or something (my paranoia, I don't know there was ever any threat of this happening). But the thought of him benefitting financially in any from that story made me feel pretty sick. Thomas heard me out and gave me the reassurances I needed despite everything going on in his own life at the moment, and I am very grateful for that. Happy to be back as a patron.

His apology on the podcast was awful. Honestly - I don't know who vetted it (legal or PR) - but someone made a very bad call there. I did contact him about a year ago to make it clear his communications with me were disrespectful and inappropriate and explain how that affected me. I did not receive a response or an apology, but didn't really expect one either. As a lawyer: I get not wanting to own up to any kind of fault. As a person: Kind of sucks.

At the time it was a little "well nobody's perfect" type thing but afterwards it made terrible sense.

It included intentional infliction of emotional distress as one of the causes of action (from memory). Now that that case has been dismissed with prejudice none of the parties can bring the matter to court again.

Not everyone that does some bad things should be thrown out as irredeemable in my book. If you don't have a path back it's got to be a lot harder to improve yourself with no possibility of forgiveness. All of that went out the window with the coup of course. Looking back, the only thing that stood out to me is when PAT posted audio from presentations or talks that he did, he referred to OA as "my podcast". It gave a kind of 'I'm the host and Thomas is my sidekick' kind of vibe. I'm kind of embarrassed that I held on to my patronage probably longer than I should have partly from not wanting to believe it, and partly hoping that PAT might continue with the monthly Q&A. Cause oh did I have questions. (sorry Thomas) It pains me to think of how much I believed that PAT was genuine.

Don't get me wrong: we Olds are responsible for evolving with the times. But it may help people understand if they reflect we were in college when campus educational programs were just starting to talk about "date rape" being a thing. Consent has evolved a LOT since we were kids.

It is a very sharp elbowed, go for it atmosphere that assumes everyone is a peer and has what it takes to push back firmly and strongly. In the end, who knows? I suspect it was behaviour that would have been accepted in some circles but not in others. At the end of the day some of his friends (Thomas and others) were aware of the issues and for whatever reason did not feel able to challenge him on it. There is more than enough lessons to go around.

When the allegations were flying, I didn't know what to believe, but when Andrew released that misleading bank statement, it was pretty clear he wasn't credible. She took the opportunity to be a co-host of a popular podcast, and who knows what PAT promised her (especially given the questionable way his business relationship was set up with Thomas). As someone who was a fan of the show before but not at all a community "insider", it seems like there were several people who saw the blowup primarily as an opportunity for themselves.

If pressed, he’d probably identify as heteroflexible.” I love how everyone is so convinced I’m an idiot that when that letter went public, everyone was like “wow, Thomas found a lawyer who really hates Andrew…” lol alright that sounded a little bitter. I guess what I mean is, I think most people underestimate me quite a bit. I was really proud of that letter and didn’t get to tell anyone I wrote it. Obviously lawyers plopped in a few tweaks for law purposes but it was almost entirely from an original letter I wrote that was much longer and even more roasty.

One of the strangest moments watching this from the sidelines was reading “Mr Smith is in fact not bisexual” in a legal letter. What was that like?

ADHD and ASD are super close cousins re: hyperfocus...and hitting burnout, sometimes suddenly and without warning. Please take care of yourself. Tell your story in your own time. Take time for yourself as you're able. It's okay to tell people to leave you alone for a few minutes. Hyperfocusing on trauma...how could this NOT have been? for you...feels weirdly good/productive/soothing, but it can flip on you really fast. Just some unsolicited advice from another nerdy neurodivergent person. Seriously, you and Lydia and Matt are amazing and I AM SO HAPPY to have this show back in my feed! That theme song is soul-affirming. OA is baaaaaaack.

He also lost his position with AA, was he held to account in any other way? Without naming them, Thomas have you had interactions with other victims since OA blew up? Do you know if he has been held to account by any lawsuit or other means? Some of this may be in the previous comments, but I didn’t see it. I know we are all very interested in the OA aspect, but his (alleged) abuse was wider-ranging, and I would love to hear there’s a possibility of some means of making his other victims whole.

When I tweeted at her generally flabbergasted way back at the beginning when she picked PAT in this whole mess, she DM’d me saying she couldn’t say anything bc of the lawsuit. Do you have ANY insight on that whole thing? Particularly since she recorded that like one episode with you right after everything came out? So bizarre.

2024-05-09 19:53:44 +0000 UTCI think there is a thing with fame and power dynamics. Fame is a form of informal soft power. It does not come packaged in formalisms like codes of conduct, positions of trust and HR Departments. As such, I don't think it's always visible to the holder. We learn in youth 'how hard' you can try when you try to flirt or pick someone up. Eventually you try too hard and get negative feedback. In this way we self calibrate. When you get famous, if you try with the same *effort*, it has much more *effect*. When people are suddenly famous, some of them don't re-calibrate appropriately. They don't realize that the lack of 'no' signals is because people fear their power, and they think they are still with in bounds. I don't know how much of this was at play here, but I think at least some of it was. This is not to excuse him. I don't know what the solution to this is. Maybe the new creator accountability thing is part of it. Maybe we need some formal thing akin to media training for the newly and suddenly famous.

If I read the timeline right, this episode happened while Andrew was *currently* ghosting Thomas on the issue of a written contract. I am curious if that was a weird conversation to edit, and if anything juicy was left on the cutting room floor?

To knowledge, I haven't seen any commentary from Morgan on the scandal except literally in the first 12 hours (from when nobody knew all the accusations yet). Morgan has seemingly kept being friends with Teresa based on social media posts since. But OTOH she quit being part of Torrez's sole led OA immediately, and then left Torrez's law firm when she could. I assume Thomas knows more; for now while it doesn't seem like she's friendly with Thomas, she doesn't seem a fan of Torrez either.

My guess is that he's just an awkward nerdy guy (I mean, Harvard lawyer) who got way too big for his boots, suddenly becoming "Internet famous" with "fans" and completely fucked up based on a power dynamic he was too wrapped up in himself to notice was problematic. You and Lydia sacrificed a LOT, and it was a risk on your part, and I don't know enough about podcasting revenues to know how soon (if ever) you expect to break even on it now. But of course, had you not had so favorable an outcome, there would have been a risk of shelling out all that money for nothing to show for it. I'm so glad you did, and prevailed! On the other hand, you achieved sole control/ ownership of the company and rid yourself of the guy (and any NDA!), not to mention all of the stress of litigation...If money had not been an issue, would you have wanted to press on with the lawsuit?

To my knowledge, there is no legal reason I can’t share them. It’s also just… a lot. We’ll see. Could hit some highlights. The other insane stuff was the letters from his lawyer. Most of those are in the public record.

More than just the one incident, he continued to message her out of the blue, including trying to meet up with her when she avoided a meet-up after a live event. Was there ever any discovery into Andrew's DMs on FB, Patreon, or other social media to determine how wide-spread this type of behavior was?

I decided to give you the benefit of the doubt due mostly to the objectively shitty behavior that Andrew was obviously guilty of (not just the sexual stuff, but the manipulation and deception he showed throughout all of his actions before and after the article) because clearly you were a victim of Andrew's disgusting behavior in one way or another. EDIT: I forgot to mention this before, but the one point made to me that struck home in your defense was that this type of call should never be on a business partner to make; thus the need for CAN. Now that it's all over, could you once and for all clear the air on what you knew, when you knew it, what you did at the time, what you didn't do, and the reasons for any inaction? To be perfectly clear, this is not an accusation of anything as the more I've heard, the more I've grown to believe in you as a person, but I think it's important to tie up this loose end. Thanks!

2024-05-08 22:05:01 +0000 UTCNot Thomas or a lawyer, but basically the times where the losing party pays all legal costs are usually when the judge/jury includes that as part of the final verdict. Since this case was settled, it would have been something that had to be negotiated as part of the settlement, which doesn't usually happen because it's a huge disincentive to settling for that party.

Very respectfully, why did you and PAndrew both not just go out and start your own new shows? You both have continued legal podcasting and it seems like a great expense could have been spared. I just want to say again that I’m so glad for you to have won back the pod and to have reached the time when you can actually speak freely. I had become a loyal OA listener by the time the old pod went 4x a week and I was just about to join on Patreon when everything went down. I’ve been through such similar experiences and felt so awful for you and Lydia. I jumped on SOI and then WTW for Patreon and was so relieved to finally become a proud OA Patreon when you came back. I wanted to share my deep appreciation for your bravery, transparency (when you’ve been able to), and determination. I can deeply empathize with the pain on your moral conscience. I have way way too many questions so may see what others articulate here first but I’m grateful. And I needed OA right now more than ever to help make it through the current legal insanity. Thank you to you and Matt and Lydia for everything.

2024-05-08 22:02:01 +0000 UTCHaving been through the legal system, where even if you’re clearly demonstrably in the right from the outset you can be in a position to have to pay enormous amounts of money just wind up with…*some* of what you had before (not nearly whole), what legal reforms would you like to see to make cases like yours less horrible for the prevailing party? Or even possible, in the case of people taken advantage of who may not have the resources to fight?

I'm sure there's a LOT more behind the scenes stuff that happened and hearing about whatever you're comfortable telling would be great. I only have one question for you. How are you and Lydia doing now that it's over? I hope well. I think it would be great to put your story together from when you first found out about the article being published all the way to the day you got signed settlement papers back from your former business partner. Only you know the key things and we might just be guessing. Take your time, put it all together into a single coherent story of as many parts as you need and tell us about it.

Not having an NDA probably feels liberating after having to keep your mouth shut during all the proceedings, but are you worried about him coming after you in a vindictive manner?
