Here's how it helps him: Trump can argue that he has a legal right to a trial later than Oct. 23, 2023 because he needs time to prepare for his defense. And right now DA Willis is pushing for an early trial date for all 19 defendants. I agree that the most likely outcome (as we'll talk about on today's show) is that Cheese & Sidney go on Oct. 23 and everyone else goes later, but this is still a significant unforced error by Willis IMO. I also think it makes it MORE likely that a conviction is reversed on appeal if the state makes any technical error in providing discovery, because Trump will argue that the motion itself was evidence of subjective bad faith.

Loved the ep, as always! I think you guys are blowing the denied willis motion out of proportion, however, at least when it comes to its potential impact on Trumps trial. I agree that looked at alone, it looks sloppy and bad. I saw it mainly as a Hail Mary attempt to fight off any future appeals based on speedy trial evidence not being provided. It was denied, though, so I don’t see how Trump can use that as reason to sever. I also don’t think it applies to trumps motion to sever, if he’s not also invoking his right to a speedy trial. Trump wants to sever specifically to AVOID speedy trial. The willis motion was talking about the speedy trial severers. I still don’t see a way that this single motion will help trump get a trial by himself.
