My first thought aligns with Thomas : “it should be some negligence tort probably”. My second thought: “is battery even a tort and not just a crime? Are all crimes also torts?” I’m going with C because the intent requires it to be a foreseeable risk of what you intended to do. If you swing a hammer and hit someone who happened to sneak up behind you it wouldn’t be battery. If you swing a hammer at someone and hit them, even if you didn’t mean to hit them, then it would be battery. So he would have to have known she was there to have the appropriate mens rea for the crime. But this is a tort not a criminal trial so this could all be wrong.
