T3BE #137: Early Answer for Patrons

Thomas analyzed this question exactly correctly -- as usual -- and also managed to get the question correct (D), breaking his losing streak!  Thomas is now 76-for-137 (55.5%).

I was thrown off by the idea in answer D that there is not a judicable controversy. The question of whether the Bureau can prohibit pasteurized beer IS a judicable controversy. But it only can be considered once the Bureau actually takes that step. I suppose the word judicable can be interpreted in different ways. I took it to mean "theoretically within the court's purview", but here it means "something which the court can and should consider at the present moment."

So what's the difference between this and the concert mass shooting case, where the hotel was suing people to stop them from suing the hotel?
