Agreed, but many bar questions are like this; they assert as part of the fact pattern something that is likely to be a disputed factual issue in real life in order to test your knowledge of the rules. Otherwise, the answer to every single bar question would be "well, it depends." :)

2018-07-11 12:53:31 +0000 UTCThe question provides "guest knows the gun is unloaded" as a given. But in the real world, I don't think it is possible to be sufficiently certain of that. Also, the pointing of enven an unleaded gun is a fairly unambiguous communication of threat.
