Premium Episode #25 - Lindsay Jellett

When 41-year-old Lindsay Jellett failed to return home from his evening walk around the Victorian town of Ararat in May 1994, staff at his residential care unit were immediately worried. As well as being intellectually disabled, Lindsay had epilepsy which required nightly medication and it wasn’t like him to lose track of time. As daybreak emerged, a grim discovery led to the question - who would want to hurt this innocent man?

Such a sad story. As always I appreciate how casefile takes care to illustrate the personalities and uniqueness of people with intellectual disabilities.

For any confused Americans: Pokies in Australia are slot machines

Devil Ray Charles

Excellent story…!

Connie Archibald

I feel bad for Judith's ex-husband too! Seemed like such a sweet guy, Judith just took advantage of anyone and everyone it seems.

mint mate

I spent the first half of the episode convinced it had to be a gang or some stranger who committed this crime. As soon as the direction turned I was horrified at who the suspect was. I spent the second half not wanting to believe. A testament to how good the writing is to craft a story in one direction and then to run it on its head.

Saraneth

Wow this was a sad one!

Andrea Johnson

Money can come between twins, even. Judith had to think about committing it every. single. day.

Alan

So sad 😢

Ali

This has to be one of the saddest and most chilling stories I’ve ever heard. To take advantage of someone so vulnerable is such a vile act in itself, but to also be a family member who you trust? Absolutely horrible.

Mandy G

Imagine having your murderer's name on your tombstone. Insane.

Amber

As someone who has a mentally disabled sibling who cannot live on his own, this makes me absolutely sick. Actually sick to my stomach. I hope that Lindsay did not suffer in his passing 😭

Megan Blair

Section 321N(3) of the Crimes Act 1958 (Vic) states that a person may be guilty of attempting to commit an offence despite the existence of facts, of which he or she is unaware, that make the commission of the offence attempted impossible.

Michael Brodie

Yes, a great episode guys. For those that think the outcome was a bit "wonky" you have to understand that under Section 321N(3) of the Crimes Act 1958 (Vic) impossibility is not a defence. Thus, if you are a thief - say a pickpocket and you get nabbed picking a pocket that was empty...it's still attempted theft....yes, for my sins I was a lawyer and had a case like this. I'll post the relevant section below...

Michael Brodie

Also Judith being like "I'll throw my ex under the bus it'll be brilliant" Her ex: destroys her alibi, destroys her cover, implicates her as a serial poisoner/drugger, hands police the motive

AR

The sheer absurdity of the judge being like "we can't let in this evidence that might lead the jury to assume things about the evidence" my bro that's what they're there for?!

AR

This case is wild. How does it keep getting wilder?!

AR

I cannot deal with that end. He deserved so much more.

SalBee

Dreadful. A very well paced episode however!

Rosie Overell

Oh the end part about him having the best day ever was just a kick in the teeth. What an evil, deluded woman.
