The Great Emu-War continues. Yuzu, once the leading Nintendo Switch emulator, has been sued out of existence by Nintendo of America. In so doing, Nintendo has revealed its complete hand, and we have, arguably for the first time, a clear look at Nintendo's complete legal strategy against emulation. In this episode, we'll break down exactly what Nintendo's argument is, and look also at the mistakes Yuzu made which allowed Nintendo to put the squeeze on them.

I had a technical question surrounding Dolphin's bundling of keys vs. Switch emulation's prod.keys situation, but I'm glad I decided to watch the video before asking it because it was pretty much answered within the elaboration of Nintendo's legal argument itself. I was under the impression that requiring an actual physical console to obtain keys from was a useful and arguably even ethical part of emulation, but it appears that it's all the same under the legal theory... which is discouraging and disappointing. Morals aren't law, but I feel like there is a case to be made there... that being said, Yuzu is flawed in significantly more ways than that, and one crack in the armor is not even close to being enough. I'm not exactly happy to be so sobered but this channel often humbles me because it says things like they are, and sometimes you're just wrong, and it requires acceptance and moving forward. Thank you Moony for educating us :) That being said, I also had learned a lot more about DMCA and its fight in the copyright office in the video game space at the start of the year, and I'm hopeful that there is a degree of change on that front. The DMCA's purpose is one that makes sense but its nature is quite overreaching by design - the idea is that individual exceptions are made, but unlike other media industries, video games have a strong lobby and not a lot of data or precedent, which has led to video game preservation through any legal means to be slowed dramatically. I hope for the future of emulation but encryption is a tough nut to crack by design, and without something as door destroying as the PS3 having a literal bug in its key generation code, I fear for a legal path to emulation. Nintendo's argument is solid and the DMCA doesn't have anything to work with yet, so any potential leads on that front is hypothetical. Emulation will either need to get crafty or stay quiet, and unfortunately Nintendo fans are very loud.
