I think the fact of what happened in that hotel room; and the manner in which Trump did or did not want to suppress what happened; and when he did or did not want to suppress it; and why he did or did not want to suppress it; are legally probative of the elements of the offenses. Notwithstanding Mr. Wittes's opinion of Ms. Daniel as a witness and his apparent lack of understanding of trauma responses, I don't see any other way to have gotten that information into evidence.

There was an interesting exchange between the judge and prosecution where the latter reminded the former that Stormy's tawdry testimony was necessary to establish motivation for Trump to want to cover it up. The condom issue was not offered for prurient interest but to add to what Trump wanted to suppress. This argument seemed to resonate with the judge.
