From a layman's POV (because I'm not a historian when it comes to the Internet), the ONLY reason why YouTube JP has different rules and terms is because it used to be a direct competitor to Nico Nico Douga at its peak. In the UK and by that extension, the US and Canada, YouTube's competition before Google bought them out in 2008, as far as video hosting went was mediocre at best, on the blue/green corner, you had MSN Video (which was OK, but very unintuitive to navigate as a signed-in user when compared to YT) and in the White/Yellow corner, you had Google Video (which, Trivia Time, was the site Ashens used before he migrated to YouTube), and no, Newgrounds doesn't count as that was more in its exclusive category of music, animation and forum group interactions, etc. By comparison, when YouTube blocked Nico Nico from using their servers for hosting purposes in mid-2007, they inadvertently created a competitor that was idiosyncratically unique for the Japanese viewer, and as such if my theory is correct, when YouTube had to compete with Nico Nico as a competitor, they relaxed a few rules. Also helped that most of the bad press and exposure from the mainstream media was restricted to North America, Britain/Ireland and Mainland Europe's user base, not Japan's until recently.
