So here's the skinny right now. I got a letter from the DA saying I need to respond by February 1st regarding whether or not I want to speak before a grand jury.
That court date would be on February 6th, and hopefully the last of this.
I meet with my lawyer on the 30th, and he'll tell me whether or not this is a good idea. Also I don't own anything nice to wear in court so we gotta figure that out.
So here's the potential punishment for grand larceny in the 4th degree (what I am accused of), 3-5 years in jail, or 3-5 years probation, either way they will make me pay back the $1100. Or, in a miracle turn of events, dismissal with retribution. Which means I am found innocent, but am still obligated to pay it back. That is best case scenario.
To kind of catch some of you up, when I was receiving rent assistance in 2016 they claim to have given me four months of cash based on false income reports. Now, not only did they wait until December of 2018 to mention anything, but I had no clue anything was wrong because my case worker made it seem as though it was all good.
What it boils down to is that my case worker or some in-betweener didn't do their job right, and I am the dumb shmuck taking the fall. Sadly, I can't prove that because they never gave me receipts for turning in my income reports, which they were SUPPOSED to do, and I didn't know that (they are notorious for half assing, I have discovered). But they get supreme benefit of the doubt and all I have is heresay.
I am stressed to my gills, folks. I haven't been able to function and lordy my body is starting to react badly to the nonsense. I'm hoping to stay out of jail at the least.
What I have on my side right now is the truth (which is worthless), heresay (also worthless), familial witnesses (also worthless), no prior criminal history (worth something), no criminal intent or knowledge (shaky ground), and nothing to hide.
I am on thin fucking ice, all things considered. They set me up good.
