2020-09-10 16:46:19 +0000 UTCTo answer your question about the law: he could raise the defence of necessity, but it's a very complicated defence to prove, and I have no idea about how it operates in America since I'm not American. Traditionally, in England, necessity can't be raised in cases of murder. I also can't find any examples of it being successfully raised during a murder case in the U.S. In Australia, you could raise the defence of sudden and extraordinary emergency, which is essentially the legislative version of necessity (which is a common law doctrine), and you would probably be successful because that defence does encompass murder within its scope. But I suppose the question is whether Casey would get away with this in the States, and the answer to that is a resounding "no idea".
